IN| The Indiana Department of Insurance issued Bulletin 276 to announce the withdrawal of its previous Bulletin 245, which addressed Association Health Plans (AHPs). This decision aligns with the U.S. Department of Labor’s (DOL) rescission of the 2018 AHP Rule, effective July 1, 2024, following a formal rulemaking process. The 2018 AHP Rule had expanded the definition of “employer” under ERISA to include sole proprietors and loosened criteria for forming AHPs. However, this rule was invalidated by a federal court in 2019 for exceeding statutory authority and contradicting ERISA’s intent. The DOL returned to pre-2018 guidance on determining whether groups qualify as “employers” for sponsoring health plans under ERISA. Consequently, the Indiana Department of Insurance is withdrawing Bulletin 245 to ensure compliance with updated federal regulations.
